  1. OWNERSHIP AND INTELLECTUAL PROPERTY

  • Copyright Preservation: The artist retains copyright ownership in all original artwork sold on this website, including applicable reproductions, digital representation, and derivative-work rights.

  • Personal Use Only: The purchase of a physical art piece grants the buyer ownership of that specific physical item for personal display. It does not grant any commercial reproduction or distribution rights.

  • Prohibited Exploitation: You may not copy, print, resell digital images of, or create derivative products from the artwork for commercial sale or profit without explicit, written licensing permission from the artist.

2.      PRODUCT DESCRIPTION AND VARIATION

  • Original Artwork: Original artworks are unique creations. Any physical textures or minor surface variations are natural characteristics of the creative medium and are not structural defects.

  • Natural Materials and Sourcing Disclosures:
    Our artwork incorporates natural and geological materials, including longleaf pine needles, waxed linen and poly thread, beads, fossils, and semiprecious gemstones. Because these components are natural, variations in color, texture, shape, and durability are to be expected and are not considered defects.

  • Gemstones and fossils are described in good faith based on the identification provided to us by our third-party suppliers. We do not independently verify or guarantee the exact geological classification, scientific identification, or origin of any stone or fossil. Descriptions of these materials are provided as supplied and are not intended as independent scientific certifications.

  • Display Accuracy: We make every effort to display the colors, dimensions, and details of our artwork accurately on our site. However, we cannot guarantee that your electronic device’s screen will accurately reflect the exact colors of the physical piece.

3.      PURCHASES AND PAYMENT PROCESSING

  • Order Acceptance: We reserve the right to refuse or cancel any order for any reason, including artwork unavailability, errors in product description or pricing, or suspected fraud. If an order is cancelled by White Trillium Studio after payment has been received, the customer will receive a refund of the amount paid for the canceled order. Customer-initiated order cancellations are subject to the cancellation terms and limitations described in our Shipping & Returns Policy.

  • Integrated Payments: Payments are processed securely through the payments providers integrated with our website. By completing a purchase, you authorize the applicable payment processor to charge your selected payment method for the total amount, including applicable shipping fees and Michigan sales tax.

4.      LIMITATION OF LIABILITY

  • Indirect Damage: To the maximum extent permitted by Michigan state law, White Trillium Studio shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from the use of our website or the handling, hanging, or display of the physical artwork after delivery.

  • Maximum Liability: Our total liability for any claim arising from a transaction on this website is strictly limited to the total purchase price paid by the customer for that specific order.

  • Nothing in these Terms is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.

  • All shipments and returns are handled in accordance with our standalone Shipping & Returns Policy, which is incorporated into these Terms. 

5.      GOVERNING LAW

  • Jurisdiction: These Terms of Service and any transaction disputes shall be governed by, interpreted, and enforced in accordance with the laws of the State of Michigan, without regard to conflicts of law principles.

6.      CHANGES TO TERMS

  • Updates: We reserve the right to update or modify these Terms of Service at any time without prior notice. Your continued use of the website following any changes constitutes your agreement to follow and be bound by the revised terms.
